Patent System & Process

Patent System in UAE

UAE patent protection has two parallel paths: (1) national patent application filed with the UAE Ministry of Economy (MOE); or (2) GCC Patent application filed with the GCC Patent Office (GCC-PO), covering all 6 GCC member states (UAE, Saudi Arabia, Kuwait, Bahrain, Qatar, Oman) with a single application. The UAE is a PCT member; the national phase deadline is 30 months from the priority date, with a full Arabic translation required.

Two Patent Protection Paths: UAE National and GCC
**1. UAE National Patent (MOE):** - Valid in the UAE only - Must be in Arabic (or with full Arabic translation) - Term: 20 years from the filing date - Filed with the Ministry of Economy IP Department (Sharjah office) **2. GCC Patent (GCC-PO):** - Single application covers all 6 GCC member states: UAE, Saudi Arabia, Kuwait, Bahrain, Qatar, Oman - Filed with the GCC Patent Office (Riyadh) - Must be in Arabic (or with full Arabic translation) - Term: 20 years under each member state's law - GCC patents take effect in each member state upon grant **Practical recommendation:** For multi-GCC coverage, the GCC route is more efficient. For UAE-only coverage, the national route suffices. Both require Arabic language filings.

PCT National Phase Entry — UAE
- Deadline: **30 months** from the priority date - A complete **Arabic translation** (specification, claims, abstract) must be submitted - National phase entry fees apply - A UAE-registered IP agent must be appointed

GCC Patent Office (GCC-PO) Details
The GCC Patent Office (GCC-PO) is located in Riyadh (Saudi Arabia) and administered by the GCC member states (UAE, Saudi Arabia, Kuwait, Bahrain, Qatar, Oman). A GCC patent application undergoes centralized examination and, upon grant, takes effect in each member state — effectively providing patent protection in 6 countries with one application. The UAE is a separate PCT member (AE can be designated for the UAE national phase). The GCC-PO itself is not a separate PCT entity — coverage of multiple GCC states is achieved through individual PCT designations or the regional GCC-PO route.

Examination Process and Timeline
The UAE MOE patent examination includes both formal and substantive examination (novelty, inventive step, industrial applicability). Overall examination timeline is approximately **2–5 years** (including waiting and response time). Recent UAE IP system reforms have improved examination efficiency.

Arabic Language Requirement
All patent applications filed with UAE MOE or GCC-PO **must include a complete Arabic text (or a full Arabic translation)**. This is a core feature of patent filing in the UAE and GCC countries. High-quality Arabic translations of the claims are especially critical.

FAQ

Common Questions — UAE IP

What are the two main patent paths for the UAE?
(1) UAE national patent: filed with the UAE Ministry of Economy; valid in UAE only. (2) GCC patent: filed with the GCC Patent Office; one application covers 6 Gulf countries (UAE, Saudi Arabia, Kuwait, Bahrain, Qatar, Oman). Both paths require Arabic-language filings. For multi-GCC coverage, the GCC route is more efficient.
What is the PCT national phase deadline for the UAE?
30 months from the priority date. A complete Arabic translation is required, and a UAE-registered agent must be appointed.
What is the GCC Patent Office and how does it relate to UAE patents?
The GCC Patent Office (GCC-PO) is a regional patent authority administered by the 6 GCC member states (UAE, Saudi Arabia, Kuwait, Bahrain, Qatar, Oman), headquartered in Riyadh.
