Patent System in Spain
Spanish invention patents are administered by the Spanish Patent and Trademark Office (OEPM), using a first-to-file system with a 20-year standard term. Spain is a member of both the European Patent Convention (EPC) and the EU; applicants can obtain patent protection in Spain via three main routes: direct national filing with OEPM; PCT national phase entry; or a European Patent via EPO validated in Spain. The European Unitary Patent is also in effect in Spain, making it an important option for European patent portfolio management.

Trademark System in Spain
Trademark protection in Spain follows two main routes: filing a Spanish national trademark with OEPM (protection only within Spain), or filing an EU trademark (EUTM) with EUIPO (covering all 27 EU member states, including Spain). For brands needing Spain-only protection, the national route is more cost-effective; for multi-country European coverage, the EUTM is generally more economical. Spain is also a Madrid Protocol member, enabling multi-country filing through the Madrid System.
