Patent System in Indonesia

Indonesian patents are administered by DJKI (Directorate General of Intellectual Property), with a 20-year term for invention patents and a 10-year term for Simple Patents (no substantive examination). Indonesia is a PCT member with a 30-month national phase deadline; a full Bahasa Indonesia translation is required. Indonesia joined the Madrid Protocol in 2018 for trademark applications.

Examination Backlog ▾

DJKI's patent examination backlog has historically been significant. Invention patents typically take **4–8 years** from filing to grant. DJKI has introduced some improvements in recent years. **Practical note:** Operating in the Indonesian market requires filing patents well in advance. Simple Patents offer a path to faster initial protection.

Madrid System (Joined 2018) ▾

Indonesia joined the Madrid Protocol in January 2018. International trademark applications can designate Indonesia. DJKI examines under Indonesian national trademark law (same as direct applications, including Bahasa Indonesia requirements).

Indonesian trademarks are administered by DJKI under a first-to-file system. Registrations are valid for 10 years from registration, renewable indefinitely. Indonesia joined the Madrid Protocol in 2018; international applications can designate Indonesia. All filings must be in Bahasa Indonesia.

Trademark Examination Process ▾

DJKI trademark examination: formal review → substantive examination (absolute and relative grounds) → publication (2 months) → registration. Typical total: ~18–36 months (without opposition).

Term and Renewal ▾

Indonesian trademark registrations: 10 years from registration; renewable every 10 years. File renewal before expiry.

Non-Use Cancellation (3 Years) ▾

An Indonesian trademark unused in Indonesia for 3 consecutive years may be cancelled by court order. The registrant must prove genuine use.
