Vietnamese patents are administered by NOIP (National Office of Intellectual Property), with a 20-year term from filing. Vietnam also offers a "Utility Solution" (lower inventive step threshold; 10-year term). Vietnam is a PCT member with a 31-month national phase deadline; a full Vietnamese translation is required. Vietnam has been a member of the Madrid Agreement since 1949 (Madrid Protocol since 2006) and can be designated via Madrid.

Vietnamese trademarks are administered by NOIP under a first-to-file system. Registrations are valid for 10 years from the filing date, renewable indefinitely. Vietnam is a member of the Madrid Agreement and Protocol; international applications can designate Vietnam. All filings must be in Vietnamese.
